Michael A Milnes and Esther N Milnes failed to respond to the IRS�s motion for summary judgement, which Tax Court granted. Tax Court explained they lacked jurisdiction to decide whether the IRS sent notices of federal tax lien to the Milnes� last known address because the authorizing legislation only applies to collection actions initiated after January 19, 1999. Tax Court also said that they lack jurisdiction to decide whether or not the IRS erroneously tried to collect employment taxes related to Michael�s law corporation, but they only gave a cite and did not explain why. Without reading the cited case, I can only guess that the corporation should have made the petition, but that seems like a bad guess if the IRS was collecting from the Milnes.
